Stereotyping
An ethical constraint within this Phizzwizard campaign is that one of the age demographics for the drink is 13-18 years and this could be seen as stereotyping teenagers as we're expecting only teenagers to like fizzy drinks.This is because in society, it is typically seen that the majority of people who drink fizzy drinks are teenagers. However this isn't the case in our campaign because we have two target audiences,one being the 13-18 target audience and the other being 30+ age demographic, so it is aimed at a greater age group, that isn't typically sterotyped when it comes to consuming fizzy drinks. When advertising the products,i made sure that i included aspects that appealed to the younger target audience and the older, so both feel included and nobody is left out.
false advertising
Another ethical constraint is false or misleading information that Phizzwizard is giving out.For example,Phizzwizard is claiming that there drink is sugar free,natural flavourings and colourings etc.To guarantee that these claims are true,ingredients of the drink will be put on the back so that the audience knows that this is true.This is important to do this because if a company is giving out false claims then you can be sued or fined and an overall bad reputation.This will lead to people feeling they can't rely on the the brand/company which could influence how well your next products do. This could also fail the compaign and lead to yo losing out on a lot of time and money.
Acessibillity
A third ethical constraint is making sure that Phizzwizzard is acessible to other countries or not language barriers when it comes to the advertising.By not having access to the drink in certain countries not only limits sales and money for Carter soft drinks but they can also be blamed for leaving out certain cultures etc.To prevent this,having a range of different languages on the marketing and allowing the product to be sold worldwide would allow everyone to feel included and a part of the campaign. This will prevent claims being made against them, and lead to the campaign becoming more successful. Making this accessible to everyone, allows the campaign to sell a lot more of their products and makes it potentially more popular as people are then likely to talk about it and introduce it to their friends and family. This can then potentially lead to the campaign going further and making more products that can be sold in different countries.
Copyright issues
A legal constraint is making sure that Phizzwizard isn't too similar to another product in terms of ingredients and taste.Having problems such as those can cause problems such as being sued or getting fined.However,Phizzwizard has some USP's where there a sugar free,strawberry lace drink which have a retro vibe to it.Although Phizzwizard has these aspects I still need to be careful when making the drink as other camaigns and companies can make claims against us when promoting and launching our drink. I need to make sure everything is our own and isn't too similar or copying others as this can cause a lot of problems, which can be prevented if we are careful to begin with.
Another legal constraint is packaging and design.This is similar to the previous point about being sued for similar for copying another products image.When designing the product i made sure that all my elements are unique and they stand out against other products. This allows people to know we are unique and that our drink is like no other they have had before. This can lead to our drink becoming very popular and making it very successful in the future. The design of the drink is unique and based off the flavouring of it, which allows people to know what it's like and whether they would be interested in it or not.
Data protection
In the pre-production stage of Phizzwizzard i wanted to use a model and a location for shooting the pictures for my adverts.When i was about to go ahead with the photoshoots i needed to make sure that i got consent from the owners that owned the location and the model etc.This is why i did a talent consent and location release forms,so i had evidence of these people agreeing that i was able to get them involved in making this Phizzwizzard campaign.If there wasn't any evidence of consent or anyone agreeing,i could get charged with an expensive fine which would ultimately juxtapose the Phizzwizzard campaign.
CONCLUSION
Overall,Phizzwizard has taken all these ethical and legal considerations into account, and have made sure that their product is unique and not influenced by other products. This should therefore help the Phizzwizzard campaign to be successful as they are new on the market and something different for people to try out. Phizzwizzard is the only of it's kind so it should be popular due to its uniqueness and should attract people to purchase it.
